Terms of Service
Ask Yogi Universe, LLC · Last updated: October 29, 2026
PLEASE READ THESE TERMS CAREFULLY. THEY AFFECT YOUR LEGAL RIGHTS. IN PARTICULAR: SECTION 4 STATES THAT THE SERVICE IS FOR ENTERTAINMENT ONLY AND MUST NOT BE RELIED ON. SECTION 8 CONCERNS ASTROLOGICAL REMEDIES THAT MAY SUGGEST SPENDING, GIFTING OR DONATING MONEY. SECTION 11 EXPLAINS OUR FREE TRIAL, AUTOMATIC RENEWAL AND OUR NO-REFUND POLICY. SECTION 12 DISCLAIMS ALL WARRANTIES AND SECTION 13 LIMITS OUR LIABILITY. SECTION 15 REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS UNDER SECTION 15.8.
1. Who we are, and what these Terms cover
These Terms of Service ("Terms") are an agreement between you and Ask Yogi Universe, LLC, a New Jersey limited liability company ("Ask Yogi", "we", "us", or "the Company").
Registered address: 971 US Highway 202N #6984, Branchburg, New Jersey 08876, USA
Email: support@askyogi.com
Website: https://www.askyogi.com/en
"App" or "Service" means the Ask Yogi Universe mobile application, our website and web app at askyogi.com, and any related features and content we make available — including horoscopes, readings, astrological remedies, AI chat, voice features, and paid reports.
By creating an account, subscribing, buying anything, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
For information about how we handle personal data, see our Privacy Policy. The Company is the data controller.
2. Eligibility and your account
2.1 Minimum age
You must be at least 13 years old to create or hold an account. The Service is not directed to children under 13, and we do not knowingly allow anyone under 13 to create an account or provide us with personal information. If we learn that we hold personal information about a child under 13, we delete it and close the account.
If you are between 13 and 18 (or the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms with you and is responsible for any purchase made through your account.
2.2 Your account
You agree to give accurate information, keep your login credentials confidential, and take responsibility for everything done through your account. Tell us at support@askyogi.com if you believe your account has been used without your permission. One person, one account; do not share or sell access to your account.
3. What the Service is
3.1 An astrology app
Ask Yogi Universe produces horoscopes, readings and other astrological content by applying astrological rules and interpretation to the birth details you provide — your date, time and place of birth, and optionally your gender.
3.2 Horoscopes and readings
The Service includes daily, weekly, monthly and yearly horoscopes, and covers a broad range of life themes, such as love and relationships, career and work, money, family, health and wellbeing, travel, study and personal growth. Content is produced for you from your own chart.
3.3 Astrological remedies
The Service suggests traditional astrological remedies — for example a colour to wear, a mantra, a favourable time, an item to keep or carry, something to buy or to give as a gift, or a donation or act of charity. Section 8 explains what these are and what they are not. Read it before acting on any remedy.
3.4 Charts for other people
The Service can produce a chart or reading about another person — a partner, a spouse, a sibling, a child, a parent or a grandparent, for example. Some of this is available only as a paid purchase. There are two ways it can happen.
(a) You enter the details yourself
You add a profile and enter that person’s date, time and place of birth together with a name or label you choose. No account is created for them and nothing is sent to them. This is the only way to add a child under 13, and only that child’s own parent or legal guardian may do it.
When you enter someone else’s birth details you confirm that you are entitled to give them to us, and that you have that person’s permission if they are an adult. Do not enter details for anyone whose information you have no right to share.
(b) You invite them to onboard themselves
You can generate a share link and send it to the person yourself, through your own messaging, email or any other means you choose. We do not send the invitation, and we do not collect that person’s email address, phone number or any other contact detail in order to invite them. A share link that is never accepted expires and is deleted after 30 days.
If they accept, they create their own account, accept these Terms and our Privacy Policy themselves, and enter their own birth details. From then on they are a user in their own right.
What you can see. While the link remains active, you can see that person’s chart and readings as part of your own subscription. You cannot see their AI chat, their voice notes or anything else private to their account.
What they can do. They may revoke your access at any time, and once they do you can no longer see their chart or readings. They can then continue using the Service only under their own subscription, which they would pay for themselves. They can also delete their own account at any time, which ends your access to their chart.
Invitations may be sent only to people aged 13 or over. Do not send a share link to a child under 13. If you want a younger child’s chart, use method (a).
Only send a share link to someone who is willing to receive it. Do not use the invitation feature to contact, pressure or repeatedly approach anyone, and do not send a link to a person who has asked you not to.
3.5 AI chat, voice notes and spoken replies
The Service includes an automated AI chat. You can type a message or record a voice note. A voice note is transcribed into text and the audio recording is then deleted immediately — we keep only the transcript, which is treated like a typed message. We do not analyse your voice or identify you by it.
The Service can also read answers aloud to you using text-to-speech. Section 10 explains in detail which systems power these features and what is sent where.
The App never records calls, and never listens at any time other than while you are holding the record button.
3.6 Profile photos
You may set a profile photo by choosing an image from your photo library or taking one with your camera, and you can crop, centre and zoom it. Setting a photo is optional. We run no face detection, facial recognition or biometric analysis on profile photos — cropping and resizing are the only processing that takes place.
You are responsible for any image you upload. Do not upload an image you have no right to use, an image of another person without their permission, or anything unlawful or obscene. We may remove an image that breaches these Terms.
Who can see your photo. Your profile photo is visible only to you, unless you share a plan with other people or are linked to them by a share link, in which case each person in that group can see the others’ profile photo alongside the charts they are entitled to see. It is never public, never visible to strangers, and never shown outside that group. If you would rather no one saw an image of you, do not set a photo — it is optional.
3.7 Location
With your permission, the Service uses your approximate, city-level location so that your daily horoscope and timings are calculated for where you actually are. We do not collect precise GPS coordinates, and we do not track your movements. If you decline the permission, you can set your city manually and the rest of the Service works normally.
3.8 Device permissions
The App asks your permission before using:
your photo library, to choose a profile photo;
your camera, to take a profile photo;
your microphone, to record a voice note;
your location, at city level, for horoscope timing; and
speech recognition, to turn a voice note into text.
Each is optional, is requested only when you first use the relevant feature, and can be refused or withdrawn in your device settings without losing the rest of the Service.
4. Entertainment only — what the Service is not
THE SERVICE IS PROVIDED FOR ENTERTAINMENT AND PERSONAL REFLECTION ONLY. EVERY HOROSCOPE, READING, REMEDY, REPORT AND AI ANSWER IS AN ASTROLOGICAL INTERPRETATION OF BIRTH DETAILS. IT IS NOT SCIENTIFIC, IS NOT BASED ON REAL-WORLD DATA ABOUT ANY PERSON OR EVENT, AND MUST NOT BE TREATED AS FACT. NO OUTCOME IS PREDICTED, PROMISED OR GUARANTEED.
Astrological interpretation is subjective. Different astrologers, and different traditions, reach different conclusions from the same chart. Nothing in the Service has been scientifically validated, and we make no claim that it has.
Any reference in the Service to a person, a relationship, a job, an illness, an amount of money, a date or an event is astrological in nature. It is not a statement that anything has happened or will happen.
5. No professional advice
Nothing in the Service is medical, psychological, health, legal, financial, investment, tax, relationship or career advice, and nothing in it substitutes for a qualified professional. Using the Service creates no professional or advisory relationship between you and us.
For any decision about your health, your money, your legal position, your family or your safety, consult an appropriately licensed professional.
6. No reliance, and assumption of risk
YOU MUST NOT RELY ON ANY HOROSCOPE, READING, REMEDY, REPORT OR AI ANSWER IN MAKING DECISIONS ABOUT YOUR HEALTH, YOUR MEDICAL TREATMENT, YOUR MONEY, YOUR INVESTMENTS, YOUR JOB, YOUR RELATIONSHIPS, YOUR FAMILY, YOUR TRAVEL, YOUR LEGAL POSITION OR YOUR SAFETY.
You use the Service entirely at your own risk and are solely responsible for your own decisions, including anything you do or decide not to do after reading or hearing something in the Service. Never delay, avoid or forgo professional advice, medical care or treatment because of anything the Service tells you.
Content about another person is not an instruction or encouragement to approach, avoid, confront, accuse, leave or take any other action toward anyone.
7. Not for emergencies
THE SERVICE IS NOT AN EMERGENCY, CRISIS, MEDICAL OR SAFETY SERVICE AND HAS NO SUCH FUNCTION. IF YOU OR ANYONE ELSE IS IN DANGER, UNWELL, OR NEEDS URGENT HELP, CONTACT LOCAL EMERGENCY SERVICES OR A QUALIFIED PROFESSIONAL IMMEDIATELY — 911 IN THE UNITED STATES, CANADA AND MEXICO; 112 IN THE EUROPEAN UNION AND THE UNITED KINGDOM; 190 OR 192 IN BRAZIL; 112 IN INDIA; OR THE EMERGENCY NUMBER FOR YOUR COUNTRY.
If you are struggling with your mental health, please speak to a doctor, a qualified mental health professional, or a crisis line in your country. The AI chat is not a counsellor, therapist or crisis service and must never be used in place of one.
8. Astrological remedies — please read this section
A remedy in the Service is a traditional astrological suggestion, offered as entertainment. It is not advice, not a prescription, and not a guarantee of any result. Remedies may suggest, for example, wearing a colour, repeating a mantra, choosing a favourable time, keeping or carrying an item, buying something, giving a gift, or making a donation or other act of charity.
8.1 We sell nothing, and we earn nothing from a remedy
We do not sell gemstones, charms, ritual items, services or any other product. We have no affiliate, commission, referral or revenue-sharing arrangement with any seller, temple, charity or practitioner, and we do not endorse, recommend or vouch for any of them. If a remedy mentions an item or a kind of gift, we gain nothing from whether or not you obtain it. What you sell, buy, give or donate, and who you deal with, is entirely your own decision and at your own risk.
8.2 Spending, gifting and donating
NEVER SPEND, GIVE OR DONATE MORE THAN YOU CAN COMFORTABLY AFFORD TO LOSE. NO PURCHASE, GIFT OR DONATION WILL CHANGE AN OUTCOME, IMPROVE YOUR LUCK, PREVENT ANY EVENT, OR PRODUCE ANY RESULT. ANY SUGGESTION THAT IT MIGHT IS ENTERTAINMENT.
A remedy is never financial advice, and must never be the basis for borrowing money, using credit, dipping into savings, or any other financial decision. We are not responsible for money you spend, lend, give away or donate, or for any dealing between you and a seller, charity or practitioner.
8.3 Health and safety
DO NOT FAST, CHANGE YOUR DIET, TAKE OR STOP TAKING ANY MEDICATION OR SUPPLEMENT, CHANGE ANY MEDICAL TREATMENT, OR DO ANYTHING PHYSICALLY RISKY BECAUSE OF A REMEDY. IF A REMEDY TOUCHES ON ANYTHING LIKE THIS, SPEAK TO A DOCTOR FIRST.
Remedies must not be used in place of medical, psychological, legal or financial care, and must never replace treatment a professional has recommended.
8.4 Your own judgement
You are free to follow a remedy or to ignore it entirely. Ignoring one has no consequence. Nothing bad happens if you do nothing, and we will never suggest otherwise.
9. Acceptable use, reporting and moderation
9.1 What you must not do
You agree not to use the Service or anything it produces:
for any unlawful purpose;
to harass, stalk, threaten, intimidate, defame or target any person;
to make decisions about another person’s employment, housing, credit, insurance, medical care or legal position;
to present our content as professional advice, as a prediction of real events, or as scientifically valid;
to build, train or improve any competing product or AI model, or to scrape, copy or extract our content; or
in any way that breaches these Terms or the rights of others.
Do not submit to the AI chat, whether typed or recorded: information about other people beyond the birth details described in Section 3.4; sensitive personal information such as health information, religious beliefs, or government identification numbers; or confidential information of any kind.
9.2 Reporting content or conduct
If you see a profile photo, a name, a message or any other content in the Service that you believe breaches these Terms — for example because it is offensive, obscene, unlawful, or is an image of someone used without their permission — you can report it to us at support@askyogi.com, and in the App wherever a report option is shown. Tell us what you saw and where, and we will look into it.
We review reports and aim to respond within a reasonable time. Where content breaches these Terms we may remove it, require it to be changed, restrict a feature, or suspend or close the account responsible, as Section 19 describes. We use a combination of automated checks and human review.
9.3 Removing someone from your group
If you share a plan with another person, or are linked to them by a share link, you can end that connection at any time in your account settings. Once you do, neither of you can see the other’s charts, readings or profile photo. You do not need a reason and we will not ask for one.
9.4 If we act on your account
If we remove your content or restrict your account, we will tell you what we did and why, unless the law prevents us or doing so would compromise an investigation. You can appeal by replying to us at support@askyogi.com, and a person who was not involved in the original decision will review it.
9.5 We do not verify anyone
We do not verify the identity, age, background or honesty of any user, and we do not run background or criminal record checks. Anyone you connect with through a share link, including someone who says they are a family member or partner, is someone you have chosen to connect with. We are not responsible for who they are, what they say, or how they behave.
10. How the AI features work
10.1 Automated, not human
The AI chat and every AI-generated reading are produced by automated systems. They are not a human astrologer, counsellor, adviser or professional, and no human reviews them before you see them. AI outputs can be inaccurate, incomplete, biased or simply wrong, and may include fabrications, sometimes called "hallucinations". They remain entertainment, and Sections 4 to 8 apply to them in full.
10.2 Which systems process your messages
By default, AI features run on the Company’s own models, hosted on our own infrastructure. This is the normal path, and on it your messages do not leave our systems or reach any third-party AI company. We do not identify the underlying model or its provider. Voice note transcription may additionally use a platform speech recognition service, as described in Section 3.5.
A third-party provider is used only as fallback or overflow — when our own model is unavailable, for example during maintenance, an update or an outage, or when demand exceeds the capacity of our own connection and we would otherwise keep you waiting. In those cases an AI feature may instead be processed by:
DeepSeek, a third-party AI provider based in the People’s Republic of China, reached through a direct connection to its interface; or
DeepSeek reached through OpenRouter, a third-party routing service that forwards requests to AI providers on our behalf. We use it so that we are not limited by the capacity of any single connection and can keep serving you quickly.
Where OpenRouter is used, both OpenRouter and DeepSeek receive the content of the request.
OpenRouter does not retain the prompts we send it — prompt logging is switched off in our account settings — and our routing is configured to use DeepSeek models only, so OpenRouter does not forward our requests to any other AI provider. We do not control either company, and each handles data under its own terms and privacy policy.
Data sent to these providers leaves your country, and in DeepSeek’s case is stored or processed in China or elsewhere, under privacy laws that may offer less protection than your own. The Privacy Policy sets out exactly what is and is not sent.
10.3 Voice notes and spoken replies
A voice note is transcribed into text and the audio is deleted immediately afterwards. Transcription may be performed by our own systems, by DeepSeek, or by the speech recognition service built into your device’s platform.
When the Service reads an answer aloud, the text of that answer is converted to speech either on your own device or, where the conversion is done on a server, by the text-to-speech service of Amazon Web Services, which is also our hosting provider. No other company is involved.
10.4 We do not train on your content
We do not use your chat content, voice note transcripts, profile photo or birth details to train or improve any AI model, ours or anyone else’s.
10.5 No liability for AI providers
We are not responsible for the acts, omissions, errors, outages, security incidents, data handling or service changes of DeepSeek, OpenRouter, any speech or text-to-speech provider, or any other third party. We may change, add, suspend or discontinue any AI feature or provider at any time. If you are dissatisfied with an AI feature, your remedy is to stop using it.
11. Purchases, subscriptions, trials and refunds
11.1 Where you can buy, and who takes the payment
You can buy from inside the App, or on our website and web app at askyogi.com. The App may also link you out to our website to complete a purchase there. Which of the arrangements below applies depends on where the purchase actually completes, not on where you started. Everything we sell on the website is also available to buy inside the App. Who processes your payment depends on where you buy:
In the App — the Apple App Store or the Google Play Store. We never receive or store a full payment card number.
On our website or web app — DoDo Payments, Inc., which acts as merchant of record for those purchases. That means DoDo Payments, not us, is the seller of record for the transaction: it takes the payment, issues the receipt, accounts for any sales tax or VAT, and will appear on your card or bank statement. Its own terms apply to the payment transaction alongside these Terms, and we never receive or store a full payment card number — we receive only the last four digits and the billing postal code.
We use a subscription management service to keep your subscription status consistent across platforms. Current prices, plan lengths and trial terms are shown before you complete any purchase. Prices shown may include tax collected by the merchant of record for your country.
What you will see on your statement. A purchase made on our website or web app may appear on your card or bank statement under the name of DoDo Payments rather than Ask Yogi Universe. If you see a charge you do not recognise, please check for that name before disputing it, and contact us at support@askyogi.com — we can identify the purchase for you.
11.2 What you can buy
Subscriptions, which renew automatically for the period you chose until you cancel; and
one-time purchases, such as individual reports by category, which are delivered once and do not renew.
Everything we sell is supplied to you in full, immediately
All of our products are digital content that is supplied in full at the moment of purchase, not released to you over time. When you buy a report, it is generated and made available to you at once. When you start or renew a subscription, all of the content for that subscription period — including every daily, weekly, monthly and annual reading covered by it — becomes available to you immediately. You can read it, save it, screenshot it or export it straight away, and it remains yours afterwards.
Our performance is therefore complete as soon as you have access. Nothing is held back to be delivered later. Cancelling a subscription stops future charges; it does not and cannot undo content that has already been supplied to you, which is why Section 11.6 applies.
11.3 Free trial
New users may be offered a free trial. The length of the trial and the terms that apply to you are shown to you before you start it, and we may change the trial length or terms for future users at any time. We currently offer trials in two forms, and the paywall will make clear which one you are starting:
Without a payment method. You choose a plan, you are not charged, and nothing happens automatically when the trial ends. To continue, you subscribe.
With a payment method on file. You provide a card or use your store account, and if you do not cancel before the trial ends, your subscription begins automatically and your payment method is charged at the price shown when you signed up.
11.4 Automatic renewal — your consent
Where a subscription renews automatically, before you purchase we will tell you clearly: the price, the length of each renewal period, that it will renew automatically and continue to be charged until you cancel, when the charge will be taken, and how to cancel. You must give your affirmative consent to those automatic renewal terms specifically, and we will send you an acknowledgment of them that you can keep. You can cancel online at any time, by the means described below.
11.5 How to cancel
Bought in the App: cancel in your Apple or Google account settings. We cannot cancel an app store subscription for you.
Bought on our website or web app: cancel in your account settings on askyogi.com, or email support@askyogi.com and we will cancel it.
Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. Deleting the App or your account does not cancel a subscription.
11.6 Refunds
ALL PURCHASES ARE FINAL AND WE DO NOT GIVE REFUNDS.
This is because of how the Service works, as described in Section 11.2. Everything we sell is digital content supplied to you in full and immediately. The moment you have access you have received everything you paid for, and you keep it — you can read, save and export all of it on the first day. There is nothing left for us to deliver, and nothing you can give back.
Accordingly, we do not refund:
a report that has been generated or made available to you;
a subscription period whose content has been made available to you, whether or not you read it; or
dissatisfaction with any horoscope, reading, remedy, report or AI answer.
Before you buy, the price, what you are getting, and the length of any subscription are all shown to you, and you can cancel a subscription at any time to stop future charges. Please make sure you are happy with your purchase before you complete it.
This no-refund policy applies except where a refund is required by law or by the rules of the store or processor you bought through. In particular:
In-app purchases are refunded, if at all, by Apple or Google under their own policies. They decide, not us, and we cannot override or limit what they choose to refund. Apple: reportaproblem.apple.com. Google: through the Play Store.
Website and web app purchases are made through DoDo Payments as merchant of record, and DoDo Payments may refund a transaction under its own policies. That decision is theirs, not ours, and we cannot override or limit it.
EU, EEA and UK consumers have the withdrawal right described in Section 11.7, which explains how it applies to content supplied in full and immediately.
Where the mandatory consumer law of your country, state or territory gives you a right to cancel or to a refund, that right applies and nothing in these Terms limits it.
Where to ask about a refund
Bought in the App — Apple or Google decide, under their own policies. Apple: reportaproblem.apple.com. Google: through the Play Store. We cannot process or override a store refund, but email us and we will help you identify the purchase.
Bought on our website or web app — contact us at support@askyogi.com. We are your point of contact for those purchases, not Apple or Google, who have no record of them. DoDo Payments, as merchant of record, may also refund a transaction under its own policies.
If a charge is wrong — you were billed twice, charged after cancelling, or charged an amount you did not agree to — that is not a refund question but an error, and we will correct it in full wherever you bought. Email support@askyogi.com.
11.7 Right of withdrawal — EU, EEA and UK consumers
If you are a consumer in the European Union, the EEA or the United Kingdom, you normally have 14 days to withdraw from a distance purchase without giving a reason. For digital content, however, that right ends once supply has begun with your express consent and your acknowledgment that you are giving the right up.
This applies to every plan, including the monthly one. A monthly subscription delivers all of that month’s content — every daily reading for the period — at the moment you subscribe or renew, exactly as the annual plan delivers a year’s content at once. There is no plan on which content is released to you gradually.
Because everything we sell is supplied to you in full and immediately, at checkout we ask you to do two things before the purchase completes:
expressly consent to the content being supplied to you immediately, rather than waiting 14 days; and
acknowledge that, once supply begins, you lose your right of withdrawal for that purchase.
You give both by ticking the box provided at checkout. Because DoDo Payments is the merchant of record for website and web app purchases, that box is presented within its checkout. Once you have ticked it and the content has been made available to you, the right of withdrawal no longer applies to that purchase, because supply is not merely begun but complete.
If you do not tick the box, we will not supply the content until the 14 days have passed, and you may withdraw at any point during that period and receive a full refund.
To withdraw where the right still applies, email support@askyogi.com. You may use the model withdrawal form but you do not have to. We will refund you within 14 days of being told, using the same payment method you used.
11.8 Payment disputes and chargebacks
If you believe a charge is wrong, contact us at support@askyogi.com and allow us 15 days to resolve it before initiating a chargeback with your bank or card issuer. Initiating a chargeback for a charge you authorised, without first contacting us, is a breach of these Terms and may result in suspension or closure of your account. Nothing in this Section limits any right you have under law or under your card issuer’s rules.
11.9 Price changes
We may change our prices. A change to the price of a renewing subscription will not take effect until your next renewal, and we will give you notice and the chance to cancel beforehand, as Section 22 describes.
12. Disclaimer of warranties
THE SERVICE AND ALL CONTENT, HOROSCOPES, READINGS, REMEDIES, REPORTS AND AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE OR FREE OF BUGS, DEFECTS OR ERRORS, OR THAT ANY DEFECT WILL BE CORRECTED.
WE SPECIFICALLY MAKE NO WARRANTY OR REPRESENTATION AS TO THE ACCURACY, RELIABILITY OR PREDICTIVE VALUE OF ANY HOROSCOPE, READING, REMEDY, REPORT OR AI OUTPUT, AND NO WARRANTY THAT ANY REMEDY WILL PRODUCE ANY RESULT. ASTROLOGICAL INTERPRETATION IS SUBJECTIVE AND IS NOT SCIENTIFICALLY VALIDATED. NO STATEMENT BY US OR BY ANY MEMBER OF OUR STAFF CREATES ANY WARRANTY.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, LOST OPPORTUNITY, BUSINESS INTERRUPTION, OR MONEY YOU SPENT, GAVE, LENT OR DONATED, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STATUTE OR ANY OTHER THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID US IN THE THIRTY DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY US DOLLARS (US$20).
IF YOU HAVE NOT PAID US ANYTHING — FOR EXAMPLE BECAUSE YOU ARE USING A FREE TRIAL, OR HAVE ONLY EVER USED THE FREE FEATURES — OUR TOTAL LIABILITY TO YOU IS ZERO.
These limits are a fundamental part of the bargain between us and apply even if a remedy fails of its essential purpose.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations of liability, and in those jurisdictions our liability is limited to the smallest amount permitted by law.
14. Your indemnity to us
To the extent permitted by law, you agree to indemnify and hold harmless Ask Yogi Universe, LLC and its members, officers, employees, agents and service providers from any third-party claim, and any resulting loss, damage, liability or reasonable legal cost, arising out of:
your breach of these Terms;
your use of the Service in a way these Terms prohibit;
anything you submit to the Service, including another person’s birth details or an image you upload; or
your conduct toward any other person.
This Section does not apply to any claim to the extent it arises from our own act or omission, and does not apply where the law does not permit it. We will notify you of any claim for which we seek indemnity and will not settle it without your consent.
15. Dispute resolution and arbitration
THIS SECTION REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION RATHER THAN IN COURT. IT WAIVES YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. YOU MAY OPT OUT WITHIN 30 DAYS UNDER SECTION 15.8. IF YOU LIVE OUTSIDE THE UNITED STATES, SECTION 16.2 MAY GIVE YOU DIFFERENT RIGHTS.
15.1 What arbitration is
Arbitration is a less formal way of resolving a dispute than a court case. A neutral arbitrator decides the dispute instead of a judge or jury. There is generally less discovery, and a court can review the outcome only in very limited circumstances. An arbitrator can award the same individual damages and relief a court could. An arbitration award binds only you and us and has no effect on any other case.
15.2 Talk to us first
Before starting an arbitration, you must send us a written Notice of Dispute at support@askyogi.com describing the dispute, what you want, and your name and contact details. We may send you a notice the same way. Neither of us may begin arbitration for 60 days after a Notice of Dispute is sent, so that we can try to resolve it informally. This period is a condition of starting arbitration, and any limitation period is paused while it runs.
15.3 Who decides whether this Section applies
You and we agree that the arbitrator, and not any court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability or formation of this Section 15, including any claim that all or part of it is void or voidable, and including any dispute about whether a particular claim must be arbitrated.
There are two exceptions, which a court and not the arbitrator decides: whether the class, collective and representative action waiver in Section 15.5 is enforceable; and any dispute about the batching provision in Section 15.5.
If you wish to challenge this delegation provision itself, you must say so specifically and separately — a challenge directed at Section 15 as a whole is for the arbitrator to decide.
15.4 Agreement to arbitrate
Except as stated in Sections 15.6 and 16.2, you and we agree that any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org. This agreement is governed by the Federal Arbitration Act. The arbitration will be conducted by a single arbitrator, in English, by written submission, telephone or video conference unless the arbitrator decides an in-person hearing is needed, in which case it will be held in the county where you live or another mutually agreed place.
To keep arbitration quick and inexpensive for both of us, discovery is limited: each of us may serve no more than five requests for documents and five written questions on the other, unless the arbitrator decides that more is genuinely needed to decide the dispute.
15.5 No class actions, no mass arbitration
You and we agree to bring claims only in an individual capacity. Neither of us may bring or participate in a class, collective, consolidated, mass or representative action, and the arbitrator may not consolidate claims or preside over any form of class or representative proceeding. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed to provide relief on that party’s own claims.
If 25 or more similar claims are brought against us by or with the assistance of the same lawyer or coordinated group, the claims will be arbitrated in sequential batches of no more than 50, each before a single arbitrator, with any limitation period paused for claims awaiting their batch.
A claim is personal to you. Any claim you have against us relating to the Service belongs to you alone. You may not assign, sell or transfer it to anyone else, and you may not authorise anyone else to bring it in your place.
This does not prevent you from being represented by a lawyer of your choosing, and does not prevent your heirs or legal representative from acting for you if you die or lose capacity.
15.6 Exceptions
Either of us may bring an individual claim in small-claims court instead of arbitration, and either of us may seek injunctive or other equitable relief in court to protect intellectual property or to stop unauthorised access to the Service. Nothing in this Section prevents you from reporting a matter to a government agency or regulator.
This arbitration agreement does not apply to a claim alleging sexual assault or sexual harassment. You may bring such a claim in court, and nothing in this Section or in Section 15.5 limits your right to do so. This reflects your rights under United States federal law.
15.7 Fees
Filing, administrative and arbitrator fees are governed by the AAA Consumer Arbitration Rules, which cap the consumer’s share. Each of us bears our own attorneys’ fees and expenses, except that the arbitrator may award fees where a claim is found to be frivolous or brought in bad faith, or where a statute provides for them.
15.8 Your 30-day right to opt out
You may reject this arbitration agreement. To do so, notify us in writing no later than 30 days after you first become subject to it. Your notice must include your name, your postal address, the email address on your account, and a clear statement that you want to opt out of the arbitration agreement. Send it to:
Ask Yogi Universe, LLC, Attn: Arbitration Opt-Out, 971 US Highway 202N #6984, Branchburg, New Jersey 08876, USA — or by email to support@askyogi.com with "Arbitration Opt-Out" in the subject line.
If you opt out, the rest of these Terms still applies to you, and opting out has no effect on any other arbitration agreement between us.
15.9 Confidentiality
You and we agree to keep the existence, content and outcome of any arbitration confidential, except as needed to enforce or challenge an award, to comply with the law, or to make a report to a government agency or regulator.
15.10 If part of this Section is unenforceable
If the class, collective and representative action waiver in Section 15.5 is held unenforceable as to a particular claim or request for relief, that claim or request will be decided by a court and severed from the arbitration, and the rest of this Section will continue to apply. If the class action waiver is held unenforceable in its entirety, this entire Section 15 is void.
15.11 Survival
This Section survives the end of your relationship with us.
16. Governing law
16.1 Delaware law
These Terms and any dispute relating to them or to the Service are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and without regard to the United Nations Convention on Contracts for the International Sale of Goods. We and you have chosen Delaware law because the Service is offered to users in many countries, and a single, well-settled and predictable body of contract law allows these Terms to be applied consistently to everyone.
16.2 Your local rights always apply
Nothing in Sections 15 or 16 takes away any right you have under the mandatory consumer protection laws of the country, state or territory where you live.
If the law where you live does not permit these Terms to be governed by the law of another jurisdiction, or does not permit a consumer to be bound by a pre-dispute agreement to arbitrate, then the law of your place of residence applies instead, and you may bring proceedings in the courts of your place of residence. If the choice of Delaware law in Section 16.1 is not given effect for any other reason, the governing law will be the law of your state or country of residence.
17. Intellectual property
We own the Service and everything in it, including its software, models, text, readings, reports, designs, trade marks and other content, and all intellectual property rights in them. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service and anything you buy from it for your own personal, non-commercial use under these Terms.
You may not resell, redistribute, publish, publicly display, reverse engineer, scrape or extract our content, or use it to build, train or improve any AI model or competing product.
You keep ownership of anything you submit, and you grant us a worldwide, non-exclusive, royalty-free licence to store, process and display it as needed to operate the Service and provide it to you. That licence ends when you delete the content or your account, except for copies retained as described in the Privacy Policy or held in routine backups. You represent that you have the right to submit anything you submit.
If you send us feedback or suggestions, we may use them without obligation or payment to you.
18. Copyright complaints
If you believe material in the Service infringes your copyright, send a written notice to support@askyogi.com with: your contact details; identification of the work you say is infringed; identification of the material you say infringes it; a statement that you have a good-faith belief the use is not authorised; a statement that the information in your notice is accurate; and your physical or electronic signature. We may remove material and close the accounts of repeat infringers. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address.
19. Suspension and termination
You may stop using the Service at any time, and may delete your account in the App or on askyogi.com. Cancelling a subscription is separate, and is done as described in Section 11.5.
We may suspend or close your account, or restrict access to any feature, if:
you breach these Terms, including Section 9;
we reasonably suspect fraud, payment fraud or chargeback abuse;
you use the Service unlawfully or to harm another person;
we learn that you are under 13; or
we are required to do so by law, or by Apple, Google or our payment processor.
Except where it would be unlawful or impractical, or where the breach is serious, we will give you notice and a chance to put things right. Where we close a paid account other than for your breach, we will refund the unused part of your current subscription period. For a purchase made in the App, that refund is issued by Apple or Google through their own process; for a purchase made on our website or web app, we arrange it directly. Closing your account does not affect any right or remedy either of us already has.
20. Export controls and sanctions
You agree to comply with all applicable export control and sanctions laws. You represent that you are not named on any US government list of sanctioned, prohibited, restricted, denied or debarred parties, and are not located in, or a national of, any country subject to a US government embargo or designated by the US government as supporting terrorism. You agree not to access or use the Service in violation of any such law, and not to submit to the Service any information subject to export control.
21. Events outside our control
We are not liable for any delay or failure to provide the Service caused by something outside our reasonable control, including natural disaster, war, civil unrest, epidemic, strike, government action, cyber-attack, or the failure or outage of a network, hosting provider, app store, payment processor or AI provider. We may suspend the Service while such an event continues.
22. Changes to these Terms
We may change these Terms. For any change that materially affects your rights or obligations — including a price increase on a renewing subscription — we will give you at least 30 days’ notice in the App and by email to the address on your account, and will say when the change takes effect. If you keep using the Service after that date, you accept the change. If you do not accept it, you may cancel your subscription and stop using the Service before it takes effect. Changes that do not materially affect you, such as correcting a typographical error or updating our contact details, take effect when posted. We will always update the "Last updated" date at the top.
Two sections are treated differently. We will not apply a change to Section 13 (limitation of liability) or Section 15 (dispute resolution and arbitration) to you unless you affirmatively accept it — continuing to use the Service is not enough. Until you accept, the version of those sections you originally agreed to continues to apply to you.
23. General
23.1 Severability
If any provision of these Terms is held invalid or unenforceable, it will be interpreted, limited or reformed to the minimum extent needed to make it enforceable while preserving its intent, or severed if that is not possible. The rest of these Terms remains in force.
23.2 No waiver
If we do not enforce a provision of these Terms on one occasion, we do not give up the right to enforce it later.
23.3 Changes must be in writing
These Terms may be changed only as described in Section 22. No oral statement changes them.
23.4 Statements by our staff
Our staff are not authorised to give medical, psychological, legal, financial or other professional advice, or to make representations about the accuracy of readings or the effect of a remedy. Nothing said by a member of our staff changes these Terms or creates a warranty. This does not affect any right you have in respect of a statement we made fraudulently.
23.5 Assignment
You may not transfer these Terms without our written consent. We may transfer them to an affiliate, or in connection with a merger, acquisition or sale of assets, provided your rights under them are not reduced.
Your account is personal to you. It cannot be transferred, sold or given to anyone else, and it ends on your death. If you tell us that an account holder has died, we will close the account and delete the data as described in the Privacy Policy.
23.6 Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and us about the Service, and replace any earlier agreement or understanding about it.
23.7 Survival
Sections 4 to 10, 12 to 18, 20 and 23 survive the end of this agreement.
23.8 Apple and Google
These Terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the Service or for any claim relating to it, and are not parties to these Terms, but may enforce them as third-party beneficiaries to the extent their own rules require.
23.9 Language
These Terms were drafted in English. We may make translations available for your convenience. If a translation conflicts with the English version, the English version prevails, except where the law of the place you live provides otherwise.
